3. User Responsibilities

3.1 Safe Usage

• Do not use the app while driving. Using mobile devices while operating a vehicle is dangerous and often illegal.
• Pull over to a safe location before submitting reports or using the app.
• Always obey traffic laws and prioritize safety over app usage.

3.2 Content Guidelines

When submitting reports, you agree to:

• Provide accurate and truthful information
• Not upload content that violates privacy rights (e.g., identifiable faces, license plates)
• Not submit defamatory, false, or malicious reports
• Not upload copyrighted material without permission
• Not harass, threaten, or target specific individuals

4. Content Ownership and License

You retain ownership of content you submit. By uploading content, you grant Frustrated Driver a worldwide, non-exclusive, royalty-free license to use, display, and distribute your content in connection with the Service.

We reserve the right to remove any content that violates these Terms or is deemed inappropriate.

5. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FRUSTRATED DRIVER AND ITS OPERATORS SHALL NOT BE LIABLE FOR:

• Any injuries, accidents, or damages resulting from reliance on reports or use of the Service
• Inaccurate, outdated, or misleading information submitted by users
• Actions or inactions by municipalities or organizations based on reports
• Data breaches, unauthorized access, or loss of data
• Indirect, incidental, consequential, or punitive damages
• Any damages exceeding $100 USD

6. User Indemnification

You agree to indemnify and hold harmless Frustrated Driver from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the Service
• Content you submit
• Your violation of these Terms
• Your violation of any rights of another person or entity

7. Privacy and Data Collection

Your use of the Service is subject to our Privacy Policy. We collect location data, user information, and submitted content. By using the Service, you consent to this collection and use.

8. Enterprise Client Responsibilities

Organizations using the Enterprise tier acknowledge that:

• Reports are user-generated and may not be verified
• They are responsible for their own response to reported issues
• Frustrated Driver is not liable for negligence claims related to unresolved reports
• They must implement their own verification and response procedures

9. Content Moderation

We employ AI-based content moderation but cannot guarantee all inappropriate content will be filtered. Users can report problematic content. We reserve the right to remove content and suspend accounts without notice.

10. Prohibited Uses

You may not:

• Use the Service while operating a vehicle
• Submit false reports or spam
• Attempt to access or interfere with the Service's security
• Use the Service for illegal purposes
• Scrape or harvest data from the Service without permission
• Impersonate others or create fake accounts

11. Third-Party Services

The Service integrates with third-party services (mapping, payment processing, etc.). Your use of these services is subject to their respective terms.

12. Subscription and Payments

Paid subscriptions are billed according to your selected plan. You may cancel at any time. Refunds are provided at our discretion. We reserve the right to change pricing with 30 days notice.
